Advertiser Terms & Conditions

A binding agreement between the Advertiser and Aussiedivorce.com.au Pty Limited ACN 106 459 527. By subscribing to our directory, you accept these terms.

This agreement is a binding contract between you, the Advertiser, and Aussiedivorce.com.au Pty Limited ACN 106 459 527 (“Aussie Divorce”). By subscribing to our website directory, you agree to these terms and conditions.

Schedule One — Membership Details

Term Initial term of 12 months, auto-renewing for subsequent 12-month periods unless terminated.
Start Date The date you accept these terms and conditions.
Basic Plan Fee $440 per 12-month period (inclusive of GST). Tax invoice available on request.
Payment Payable yearly in advance on the start date and on the first day of each subsequent 12-month period.
Fee Review We may increase fees at any time with a minimum of 28 days’ prior written notice.
Exclusive Position Specific fees for exclusive positioning are available on request.

Intellectual Property

Aussie Divorce owns and operates the website www.aussiedivorce.com.au (“the Website”), including all business methods, trademarks, and content. All material on the Website is copyrighted by Aussie Divorce.

You, as the Advertiser, are not permitted to copy, reproduce, modify, or distribute any part of the Website’s content without our explicit, written permission.

Website Subscription and Membership

2.1 — Subscription and Term

By subscribing, you agree to a membership for the term specified in Schedule One. Aussie Divorce agrees to provide you with a subscription in exchange for the fee outlined in Schedule One.

2.2 — Membership Limits

To ensure a quality directory, we limit the number of advertisers in each region to a maximum of five businesses of the same category. We reserve the right to increase this limit by up to 5% at our discretion if an advertiser’s subscription is terminated.

2.3 — No Exclusivity

Your membership is not exclusive. You acknowledge that other businesses in your area may also be listed on the Website.

2.4 — Use of Our Name

You must not use the name “Aussiedivorce” in any of your advertising or promotional materials without our prior written consent. We will not unreasonably withhold this consent.

2.5 — Location-Specific Membership

Your membership is tied to a specific office location. If you have multiple offices, each one requires a separate membership to be listed.

Advertiser Content and Website Profiles

3.1 — Advertiser Profile Page

Subject to this agreement, Aussie Divorce will provide a link to a profile page about your business (“Advertiser’s Profile Page”) on the Website. The format, placement, and selection criteria for all content on the Website are determined solely by Aussie Divorce. We reserve the right to refuse or remove your profile page at any time.

3.2 — Your Warranties

You warrant and represent that your Advertiser’s Profile Page:

  • Complies with the Competition and Consumer Act 2010.
  • Does not violate any person’s copyright, trademark, or other proprietary rights.
  • Complies with all relevant laws, regulations, and codes of conduct.
  • Does not contain any material that could imply we endorse or are affiliated with your business.
  • Does not contain any material that is critical of Aussie Divorce or its services.
  • Is not illegal, offensive, distasteful, defamatory, false, or misleading.
  • Has the consent of any living person whose name or image appears on the page.
3.3 — Data Security

You acknowledge that due to technical limitations, Aussie Divorce cannot guarantee the security or privacy of any information stored on the Website. To the extent permitted by law, you release us from any liability related to this.

Fees, Payment, and Termination

4.1 — Fees

You agree to pay the fees set out in Schedule One in the manner specified.

4.2 — Suspension and Termination

We may suspend or terminate this agreement and remove your profile page if you:

  • Fail to pay the fee.
  • Become insolvent or bankrupt.
  • Fail to comply with any of these terms and conditions.
  • Receive client feedback that we, in our sole discretion, determine indicates an unacceptable level of service. In this case, we will refund any prepaid fees on a pro-rata basis for the remainder of the three-month period.
4.3 — Your Right to Terminate

You may terminate this agreement by providing 28 days’ written notice, or by simply not paying the fee at the beginning of a new 12-month term.

4.4 — Disclaimer of Liability

We are not liable for any losses or damages, including indirect, special, economic, or consequential loss (such as loss of profits, revenue, or business opportunity), that you or any other person may incur from using or relying on the Website. You are responsible for ensuring the accuracy of your content and assume all risk associated with this agreement.

4.5 — Limitation of Liability

To the maximum extent permitted by law, our liability for any breach of this agreement is limited to a refund of the fees you have paid for a maximum period of three months.

4.6 — Indemnity

You agree to indemnify us against all costs, expenses, losses, damages, and liabilities we may suffer as a result of your breach of these terms.
